Couple with Denied Claim

Combating Denied Homeowners & Life/Accidental Death Insurance Claims

The main reason you buy homeowners insurance is to cover the cost of damage to your house and property. For this reason, you naturally expect the insurance company to cooperate and cover the costs after a hailstorm, fire or other disaster. Similarly, you purchase life or accidental death insurance policies as a way to protect your families in the event of an unexpected death, either as a result of unforeseen natural causes, or as the result of an accident.

Unfortunately, This Doesn’t Always Happen.

Too many insurance companies try to increase their own profit by disputing, denying, delaying or underpaying legitimate claims and purposefully interpreting and manipulating the language in their policies to minimize or deny valid homeowners and life insurance claims.

For example, in homeowner claims, it’s easy to assume that the contractor who assesses your property damage is impartial. However, this isn’t always the case. The truth is that insurance companies will often use preferred contractors to give themselves an advantage.  The insurance claims adjuster will then assign a much lower value for replacing or repairing the damaged property or even completely deny the claim.

Similarly, in life or accidental death insurance claims, an insurance company may claim that the policyholder did not completely disclose information, there was suspected foul play by the beneficiaries (even without evidence of a criminal investigation), or that the cause of death falls under a list of exclusions such as suicide (again without any evidence of the same).

Often the larger the potential claim/payout, the higher the chance for a dispute or denial.

If you are a victim of insurance bad faith, you deserve to have a knowledgeable legal advocate on your side. Attorney Pamela Borgess of Borgess Law has decades of litigation experience and has the skill you need to combat the injustice from an insurance company’s wrongful claim denial. In some cases, it may be possible to gain punitive damages (extra money awarded by the court) in addition to the past-due insurance payments you deserve.

The Sooner, The Better

As soon as the event occurs, insurance companies are often focused on collecting evidence to bolster a denial or a deliberately low estimate. This starts from your first call to open the claim! The sooner you have your own representation, the sooner a wrongful dispute or denial can be challenged. Insurance companies often do not hesitate to dispute or deny claims without sufficient evidence or justification for unrepresented claimants who they don’t believe will have the ability to seek a remedy in court if necessary.  They are far less likely when an attorney is involved and ready to protect your rights, including in court, if necessary.
